Senator Mattera Proposes Legislation to Combat Squatting Epidemic in New York State

New York State Senator Mattera has voiced concerns over the rising issue of squatting in the state and the inadequacy of current laws to address this problem effectively. In response to this, the senator has introduced a comprehensive legislative proposal aimed at tackling the squatting epidemic.

"It is overwhelmingly clear that the laws of this state fall way short of addressing the squatter issue effectively," Senator Mattera stated, highlighting the urgency of the situation.

The proposed four-part legislative package includes a primary statute, S.8867, which would enable law enforcement to quickly evict individuals from residential properties upon a homeowner's sworn complaint, without the need for court involvement. In addition to this, the package consists of three other pieces of legislation:

- S8866: Redefining the definition of occupant to exclude squatters and trespassers, preventing self-help evictions.

- S8868: Excluding squatters and trespassers from the current squatter-friendly remedy for self-help evictions.

- S8669: Clarifying that criminal trespass in the third degree encompasses squatting.

Senator Mattera emphasized, "This is a fair and just mechanism to provide a rapid solution to the problems facing our property owners and it is sorely needed. It seeks to reverse the current trend that favors squatters and trespassers over homeowners, restoring fundamental rights to the rightful owners of our great state."

"It is time we end the squatting epidemic and I hope you will join me in getting needed protections in New York State law," concluded Senator Mattera, calling for support in combating the issue.
